Terms of Service

These Terms govern your use of Tiwora. They cover the recurring subscription tiers, our no-refund policy, acceptable API use, and governing law.

§01

Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Belkhiria LTD (trading as Tiwora), a company registered in England & Wales, United Kingdom ("Tiwora", "we", "us"). By creating an account, accessing our website, or purchasing a subscription, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" and "Customer" shall refer to that entity. If you do not agree to these Terms, you must not use the Service.

§02

Description of the Service

Tiwora is a business-to-business software-as-a-service platform that provides localised prospecting tools, including B2B lead search powered by the Google Places API, AI-assisted lead auditing and outreach copy generation, and a growth workspace for email warm-up tracking. The features available to you depend on the subscription tier you have activated.

We may modify, replace, or discontinue individual features at any time to improve the Service, comply with legal obligations, or protect the platform's integrity. Where a change materially reduces the value of a paid tier, we will notify you at least thirty (30) days in advance.

§03

Accounts, Credentials & Free Trial

You are responsible for maintaining the confidentiality of the credentials you use to access your account and for all activities that occur under it. You must notify us immediately at contact@tiwora.com of any suspected unauthorised access.

New accounts receive three (3) free credits at signup so that you may evaluate the Service by running a single 100-lead batch before purchasing. The three credits are non-transferable, have no cash value, and are consumed on the top three leads of your first batch — the remaining leads in that batch remain visually masked until you subscribe to a paid plan. Consumption of these credits constitutes acknowledgement that you have had the opportunity to test the Service before subscribing.

§04

Subscription Terms & Automatic Renewal

Paid access is delivered as recurring subscriptions billed through Stripe Payments Europe, Ltd. ("Stripe"). Three tiers are offered:

  • Starter — USD $49 per month · 4,000 monthly credits · full 100-lead batches · basic data extraction (excludes Tiwora AI Score, Google Rating filters, and automated GPT analysis).
  • Growth — USD $149 per month · 8,000 monthly credits · full 100-lead batches · Tiwora AI Engine, Automated Vulnerability Audits, and Advanced Google Rating & AI Filters included. Most Popular tier.
  • Pro — USD $299 per month · 20,000 monthly credits · full 100-lead batches · all AI features and advanced filters included · premium gpt-4o audits · invitation-only, provisioned manually after sales vetting.

Each subscription renews automatically at the end of its billing cycle (monthly or yearly) for a new period of the same length, at the then-current price for that tier, until you cancel. By providing your payment method you authorise Stripe, on our behalf, to charge that payment method at the start of each renewal period.

You can cancel a subscription at any time from the "Manage billing" area of your account, which opens the Stripe Customer Portal. Cancellation takes effect at the end of the current paid period; you retain access — and any unused credits associated with the cycle — until that date, after which the Service reverts to the free-tier state without penalty.

Where applicable law requires (for example the fourteen-day right of withdrawal under UK consumer regulations), that right applies exclusively before you begin substantial use of the Service. By activating a subscription and consuming credits, you expressly acknowledge that performance of the digital service has begun and you waive that right in accordance with UK statutory instruments.

§05

Billing, Taxes & Payment Method

All fees are stated exclusive of applicable VAT, GST, or other transaction taxes, which will be added at checkout in accordance with your billing jurisdiction as determined by Stripe. Payment is due upfront for the entire billing cycle.

You are responsible for maintaining a valid payment method. If a renewal charge is declined, we may suspend paid features until payment is successfully processed. Repeated declines over a period of seven (7) consecutive days may result in the subscription being terminated automatically.

§06

No-Refund Policy

All sales are final and non-refundable. Given (a) the immediate digital nature of the Service, (b) the free credit provided at signup for evaluation purposes, and (c) the ability to cancel any active subscription at any time via the Stripe Customer Portal to prevent future renewals, we do not issue refunds or credits — whether partial or full — for previously charged billing cycles, unused portions of a cycle, unused credits, downgrades, or account inactivity.

This policy applies to monthly and yearly subscriptions and to one-time credit top-ups alike. Refunds may be granted only where required by mandatory local consumer-protection laws that cannot be lawfully waived; in such cases the refund amount is limited to the strict minimum required by that law.

Chargebacks or payment disputes initiated with your bank or card issuer without first contacting contact@tiwora.com will be treated as a material breach of these Terms and may result in immediate termination of your account and permanent loss of associated data.

§07

Acceptable Use & API Data

The Service exposes data sourced through third-party providers, most notably the Google Places API. Your use of that data is subject to both these Terms and the Google Maps Platform Terms of Service. You may not:

  • Scrape, spider, mass-download, or otherwise extract data outside the intended user interface and documented API endpoints.
  • Store or redistribute Google Places content beyond the caching windows and permitted uses set out by Google's own terms.
  • Use the Service to compile a database intended to compete with Google or Tiwora, or to resell raw place data to third parties.
  • Attempt to reverse engineer, decompile, or bypass any technical protection, rate limiter, or usage cap.
  • Send unsolicited bulk email, run illegal marketing campaigns, or use the outreach tooling for phishing, scams, or activities prohibited by any applicable anti-spam law (CAN-SPAM, PECR, RGPD, CASL, or equivalents).
  • Upload or transmit any content that is unlawful, defamatory, malicious, or that infringes third-party rights.

We monitor aggregate usage patterns for signs of abuse (including unusually high credit burn rates, headless scraping fingerprints, and repeated failed authentication). Where abuse is reasonably suspected we may throttle, suspend, or terminate the offending account immediately and without prior notice, and retain the right to preserve evidence for any subsequent legal action.

§08

Intellectual Property

The Service, including its source code, design, trademarks, and all associated documentation, is the exclusive property of Tiwora and its licensors. Nothing in these Terms transfers ownership of any intellectual-property right to you. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for the duration of your active subscription, solely for your internal business purposes.

Any feedback, suggestions, or improvement ideas you submit may be used by Tiwora without restriction and without any obligation of compensation or attribution.

§09

Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". To the maximum extent permitted by law, Tiwora expressly disclaims all warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that any lead, contact, or business record surfaced through the Service is complete, current, accurate, or fit for any specific outreach programme.

To the maximum extent permitted by law, and except for liability that cannot be excluded under English law (including death or personal injury caused by negligence and fraudulent misrepresentation), Tiwora's aggregate liability arising out of or in connection with these Terms or the Service is capped at the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

In no event will Tiwora be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, nor for loss of profits, revenue, goodwill, business opportunity, or data — even if we have been advised of the possibility of such damages.

§10

Suspension & Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, if required to do so by law, or if continued provision of the Service to you exposes Tiwora, its users, or third parties to material risk. In cases of demonstrable abuse of API quotas or scraping activity, suspension will be immediate.

You may terminate your subscription at any time via the Stripe Customer Portal. Upon termination for any reason, your right to use the Service ends immediately; any provisions of these Terms that by their nature should survive termination (including intellectual property, no-refund policy, liability caps, and governing law) will continue in force.

§11

Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes), are governed by, and construed in accordance with, the laws of England & Wales, United Kingdom, without regard to conflict-of-law principles.

You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim. Nothing in this section shall limit the right of Tiwora to bring proceedings against you in any other court of competent jurisdiction to protect its intellectual-property rights.

§12

Changes to these Terms

We may revise these Terms from time to time. When we make material changes we will update the "Effective as of" date at the top of this page and, for changes that affect subscription pricing, cancellation rights, or your data, notify you by email at least thirty (30) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
